Mexico celebrates the introduction of the Artist’s Resale Right
Artists in Mexico are celebrating the introduction of the Artist’s Resale Right after almost 20 years of campaigning.
Last month the Mexico Copyright Office published the official Resale Right Tariffs which make it possible for these important royalty payments for artists to go ahead.
The tariffs apply to any resale of an original artwork by an art market professional. As in most countries around the world, royalties paid to visual artists in Mexico are calculated as a percentage of the artwork’s selling price. Rates range between 4% and 1.25% as an artwork’s selling price falls within different price bands.
Auction houses, galleries and other art dealers are required to notify the local collective management organisation, DACS’ sister society SOMAAP, of any resale of an artwork.
This new regulation is the result of joint lobbying efforts by SOMAAP and the Latin American visual arts copyright societies, coordinated by CISAC - the International Confederation of Societies of Authors and Composers.

- 4% when the sale price of the work is from $1.00 to $50 thousand pesos (MX)
- 3% when the sale price of the work is from $50,001 to 200,000 pesos (MX)
- 2% when the sale price of the work is from $200,001 to $500,000 pesos (MX)
- 1% when the sale price of the work is greater than $500,001 pesos (MX)
